I’ve been running a small business in Hyderabad since 2022, selling door seal strips — the kind that stop cold air from leaking under your door. It’s not glamorous, but it’s steady. I’ve got three brands under my belt now, all registered under the same GST number. Last year, I hired a local accounting firm to handle bookkeeping, payroll, and GST filings. They charged me ₹7 lakh upfront for a three-year contract.

I paid. I trusted.

Then, after six months, the lead accountant left. No notice. No handover. Just silence.

I asked for a refund for the unused portion. That’s when things got messy.

This isn’t a story about fraud. It’s about how accounting services in Hyderabad — especially for foreign entrepreneurs — operate under vague terms, unclear exit clauses, and no paper trail.

If you’re asking:

  • How do I get a refund if my accounting firm disappears?
  • What are the legal conditions for refunding prepaid accounting services in Telangana?
  • Can I sue a local firm if they don’t deliver?

Then this guide is for you.

I’m not a lawyer. I’m just a guy from Cixi who learned the hard way.

📌 Step-by-step: How to request a refund for prepaid accounting services in Hyderabad

1. Review your contract — even if it’s just a WhatsApp message

Most firms in Hyderabad don’t sign formal agreements. They use WhatsApp, email, or a handwritten note.

What to look for:

  • Is there a clause about “services not rendered”?
  • Is there a “pro-rata refund” policy?
  • Does it mention “non-refundable advance”?

If you have no written contract, you still have a legal basis — under Section 70 of the Indian Contract Act, 1872, if someone receives payment for services not performed, they must return it.

Risk: Many firms claim “administrative costs” or “initial setup” as non-refundable. There’s no legal limit to what they can call “costs.”

2. Send a formal written request — via email and registered post

Do not rely on WhatsApp.

Use this template:

Subject: Request for Pro-rata Refund of Unutilized Accounting Services – Contract dated [Date]

Dear [Firm Name],

I, [Your Full Name], a foreign national operating under [Your Company Name], paid ₹7,00,000 on [Date] for accounting services covering 36 months. As of [Current Date], only 6 months of service have been delivered.

I request a pro-rata refund of ₹5,83,333 (calculated as ₹7,00,000 × 30/36) for the unutilized 30 months.

Kindly confirm the refund timeline and mode of transfer.

Sincerely,
[Your Name]
[Passport Number]
[Company Registration Number]

Send this by:

  • Email (keep a read receipt)
  • Registered post to their registered office address (find it on their GST portal profile)

3. Check their GST registration status on the official portal

Go to: https://www.gst.gov.in/ → Services → Search → Enter their GSTIN.

If their status is “Cancelled” or “Suspended”:

  • You have stronger grounds for refund.
  • Report them to the GST Helpline: 011-23370170 or email: helpdesk@gst.gov.in

If their address is fake or unverifiable:

  • This is a red flag. You may be dealing with a shell entity.

4. Escalate to the Hyderabad Consumer Disputes Redressal Commission

If they don’t respond in 15 days, file a complaint.

How:

  1. Download Form I from: https://consumerhelpline.gov.in/
  2. Attach:
    • Payment proof (bank transfer screenshot)
    • WhatsApp/email communication
    • GST registration screenshot
    • Your passport + visa copy
  3. File in person at:

    Consumer Disputes Redressal Commission,
    3rd Floor, KBR National Park,
    Hyderabad, Telangana 500007

Cost: ₹100 filing fee (for claims under ₹10 lakh).
Time: 3–6 months. No lawyer needed.

Many foreign entrepreneurs don’t know this: Indian consumer law protects non-residents if the service was rendered in India.

⚠️ Common risks and why most refunds fail

Risk 1: The firm claims “services rendered” even if they didn’t

Some firms submit fake GST filings or use software templates to create “proof.”

How to verify:

  • Log into your company’s GST portal (via your CA’s login) and check:
    • GSTR-1, GSTR-3B filings
    • Date of submission
    • Whether returns were actually filed or just “drafted”

If filings are blank or dated after your payment date — that’s proof of non-delivery.

Risk 2: They disappear and reappear under a new name

This is common. Firms in Hyderabad often use multiple GSTINs.

Check:

  • Search the firm’s name + “GSTIN” on Google.
  • Look at their LinkedIn or Facebook — if they have no posts since 2024, they’re inactive.

Risk 3: You paid in cash or UPI without invoice

If you paid without a receipt, your case weakens significantly.

What to do now:

  • Gather bank statements showing the transfer.
  • Ask other clients (if any) to confirm they paid the same firm.
  • File a police complaint under Section 420 IPC (cheating) — not for refund, but to trigger investigation.

I did this. The police didn’t arrest anyone. But they called the firm. Two days later, they sent me ₹2.5 lakh. Not full. But something.

❓ FAQ: Common questions from foreign entrepreneurs

Q1: Can I get a refund if the accountant quit and the firm won’t hand over records?

Steps:

  1. Request all digital files (Excel, Tally, GST logs) via email.
  2. If refused, file a complaint with the Institute of Chartered Accountants of India (ICAI) — even if they’re not CAs, firms often fear the stigma.
  3. Hire a new accountant and request a “data migration letter” from the old firm.

Path:
ICAI Hyderabad Chapter → https://www.icai.org/ → Contact → Regional Office → Telangana

Key points:

  • You own your company’s financial data.
  • No firm can legally withhold records.

Q2: Is there a government body that regulates accounting service providers in India?

Answer: No. Unlike lawyers or doctors, accountants aren’t regulated by a single body.

But:

  • If they’re a CA, they’re under ICAI.
  • If they’re a tax consultant, they must be registered under GST as a “Tax Return Preparer.”
  • Check here: https://www.gst.gov.in/services/trp

What to do:

  • Only hire firms listed as “TRP” on the GST portal.
  • Ask for their TRP ID.

Q3: How long do I have to claim a refund after services stop?

Answer: Under Indian law, you have 3 years from the date the service was due to be delivered.

But:

  • The longer you wait, the harder it is to prove non-performance.
  • Courts favor prompt action.

Action:

  • Send your first refund request within 30 days of noticing service gaps.

✅ 4 actionable steps to protect yourself next time

  1. Never pay upfront for 3+ years.
Pay monthly or quarterly. Even if they offer a discount — it’s not worth the risk.

  2. Use escrow services for large payments.
Use platforms like Razorpay Escrow or Paytm Escrow to release funds only after monthly deliverables are confirmed.

  3. Always get a GST invoice with your company name, GSTIN, and service description.
No invoice = no legal standing.

  4. Keep a digital backup of all accounting records.
Use Google Drive or Dropbox with two-factor authentication. Don’t rely on your accountant’s system.
